Membership Terms and Conditions
1.About these terms
1.1 These terms apply to memberships, class packages, courses, pay-as-you-go bookings and trials supplied by Unstoppable Mindset Ltd, trading as Just Train ("Just Train", "we", "us" or "our").
1.2 By purchasing or activating a membership, package, course, booking or trial, you (the "member") agree to these terms. If the member is aged 16 or 17, a parent or legal guardian must also provide consent and agree to these terms on the member's behalf.
1.3 The membership or product description shown before purchase—including its price, duration, included services and any specific restrictions—forms part of the agreement between you and Just Train.
1.4 Nothing in these terms affects your statutory consumer rights.
2.Membership and purchase options
2.1 Just Train may offer:
- monthly rolling memberships;
- fixed-term memberships;
- class packages or class credits;
- courses;
- pay-as-you-go sessions; and
- free or promotional trials.
2.2 The price, duration, class allowance, expiry date and other material conditions will be displayed before purchase.
2.3 Monthly rolling memberships continue until cancelled in accordance with section 7.
2.4 A fixed-term membership runs for the period stated at purchase. It will end at the end of that period unless you expressly agree to renew it or the pre-purchase information clearly states that it will become a rolling membership afterwards.
2.5 Class packages and credits must be used by any expiry date clearly displayed before purchase. Unless required by law or agreed by Just Train because of exceptional circumstances, unused credits cannot be refunded, transferred or carried beyond that date.
2.6 A course covers only the dates, sessions and content described at purchase. Missing a course session does not normally create a right to a replacement session or refund.
2.7 Trial eligibility and restrictions will be stated when the trial is offered. Unless expressly stated otherwise, a person may use each introductory trial offer only once.
3.Joining and member information
3.1 You must provide accurate, complete and current information when joining and must keep your contact and payment details up to date.
3.2 Membership is personal to the named member. Memberships, bookings, credits and access rights must not be shared, sold or transferred.
3.3 We may refuse or delay activation where reasonably necessary to confirm identity, age, parental consent, payment or information relevant to safe participation.
4.Age requirements and children
4.1 The minimum age for membership or participation is 16.
4.2 Members aged 16 or 17 require consent from a parent or legal guardian before participating. We may also require the parent or guardian to complete or approve relevant registration and health information.
4.3 Children under 16 are not permitted in the gym or training areas, including as spectators, unless Just Train has expressly organised and supervised a specific activity for them.
5.Health, safety and participation
5.1 Before participating, you must complete Just Train's health and physical activity questionnaire honestly and accurately. Completion of the questionnaire is a screening measure and is not medical advice, diagnosis or medical clearance.
5.2 You must tell us promptly if your health, medication, pregnancy status, injury status or ability to exercise changes, or if a healthcare professional advises you to restrict or stop physical activity.
5.3 A disclosed condition or injury does not necessarily prevent participation. We may reasonably ask for further information, recommend suitable adaptations or ask you to obtain advice from an appropriate healthcare professional before participating.
5.4 You are responsible for working within your abilities, following coaching and safety instructions, and stopping immediately if you experience chest pain, dizziness, faintness, unusual breathlessness, sudden pain or any other concerning symptom. You must tell a Just Train coach or member of staff immediately.
5.5 Exercise carries inherent risks, including fatigue, muscular soreness and accidental injury. You voluntarily accept the ordinary risks inherent in properly instructed physical activity. This does not exclude or restrict any liability that cannot lawfully be excluded.
5.6 In an emergency, we may contact the emergency services and the emergency contact supplied by you. Any first aid or emergency assistance will be provided according to the circumstances and the training of the person responding.
6.Payments
6.1 Membership fees are normally collected by Direct Debit. Pay-as-you-go sessions, class packages and courses may be paid for by debit or credit card. Available methods will be shown at purchase.
6.2 You authorise us and our payment providers to collect the amounts and on the dates disclosed before purchase.
6.3 You must ensure that sufficient funds are available. If a payment fails, we may contact you, attempt collection again and temporarily suspend booking or access until the amount due is paid.
6.4 We will not charge an administrative or failed-payment fee unless that fee was clearly disclosed before purchase and represents a fair and proportionate cost.
6.5 You remain responsible for membership payments due until your membership has ended in accordance with these terms. Cancelling a Direct Debit with your bank does not by itself cancel your membership.
6.6 Prices include VAT where applicable.
7.Cancelling a monthly rolling membership
7.1 You may cancel a monthly rolling membership at any time by giving one month's notice through the gym software or by written notice sent to our customer contact email or postal address.
7.2 Notice begins when we receive it. We will confirm the cancellation and tell you the final payment date and membership end date.
7.3 Membership access and payment obligations continue during the notice period. Where a normal payment falls due during that period, it will be collected unless we confirm otherwise.
7.4 If you believe we have not acknowledged a cancellation request, please contact us promptly and retain evidence showing when the request was submitted.
8.Fixed terms, packages, courses and individual bookings
8.1 A fixed-term membership cannot normally be ended early simply because you no longer wish to attend. However, we will consider a reasonable request to end or freeze it because of a substantial change in circumstances, such as serious illness or injury, pregnancy, redundancy, relocation or another event that makes continued participation impracticable. We may request reasonable supporting evidence.
8.2 Our decision under section 8.1 will take account of the circumstances and consumer law. Any early-ending charge must be fair and proportionate and will not exceed the sums that would otherwise have become payable.
8.3 Pay-as-you-go bookings, class credits, packages and courses are subject to the booking and cancellation rules in section 10, together with any specific fair conditions displayed before purchase.
9.Membership freezes
9.1 You may ask us to freeze a membership because of illness, injury, pregnancy, travel, financial hardship or another significant personal circumstance.
9.2 Freeze requests must be made through the gym software or in writing. Wherever reasonably possible, they should be made before the requested freeze begins.
9.3 A freeze is not active until we confirm it in writing. Our confirmation will state its start date, expected end date, effect on payments and any revised membership end date.
9.4 We may ask for reasonable evidence where necessary, but we will not request more health or personal information than is reasonably required.
9.5 During a freeze, membership access and booking rights are paused. A frozen membership must not be used unless we have agreed otherwise.
9.6 We will consider requests fairly and may agree an extension where circumstances continue. We may contact you before reactivation.
10.Class bookings, cancellations and no-shows
10.1 Places are subject to availability and must be booked through the approved booking system unless we agree otherwise.
10.2 If you cannot attend, you should cancel at least 24 hours before the class start time so that the space can be offered to another member.
10.3 If you cancel with less than 24 hours' notice or do not attend, we will normally send a polite reminder of the booking policy. Just Train does not currently impose an automatic late-cancellation or no-show charge.
10.4 We reserve the right to introduce a fair late-cancellation policy if repeated missed bookings materially affect other members. We will provide reasonable advance notice before any fee or loss of credit takes effect; it will not apply retrospectively.
10.5 Please arrive in time to participate safely. A coach may refuse late entry where the warm-up or safety briefing has been missed or where entry would disrupt or endanger the class.
10.6 We may cancel, combine, relocate or change a class, coach or timetable where reasonably necessary. We will try to give reasonable notice. If we cancel a separately paid session, we will normally offer a replacement booking, restore the credit or provide an appropriate refund.
11.Cooling-off rights for online and distance purchases
11.1 Where the law provides a right to cancel an online or other distance contract, you may cancel within 14 days beginning on the day after the contract is made, without giving a reason.
11.2 To cancel during this period, submit a clear cancellation request through the gym software or contact us using the details at the beginning of these terms.
11.3 If you ask us to start providing membership services during the 14-day cancellation period, you expressly request early performance of the contract. If you then cancel within that period, we may deduct a fair proportion for services supplied up to the time of cancellation, where the law permits.
11.4 Some leisure services booked for a specific date or period may be exempt from the statutory cooling-off right. Any applicable booking-cancellation rights will still be explained before purchase, and your statutory rights remain unaffected.
11.5 Approved refunds will be made using the original payment method unless otherwise agreed and within the period required by law.
12.Gym rules
12.1 You must behave respectfully toward members, coaches, staff, visitors and neighbours. Abusive, threatening, discriminatory, harassing, dangerous or deliberately disruptive conduct will not be tolerated.
12.2 Outdoor footwear must not be worn in the gym or training areas. Members must change into clean, suitable indoor training footwear before entering those areas.
12.3 Personal belongings must not be left in the gym or training areas. They must be kept in any designated storage area or otherwise secured outside the training space.
12.4 Equipment may be used only for its intended purpose and in accordance with instructions, demonstrations, signage and guidance given by Just Train coaches or staff.
12.5 You must not use equipment that you do not know how to operate safely. Ask a coach or member of staff for guidance.
12.6 Equipment must be returned safely after use. Damage, defects, hazards, spillages, injuries and accidents must be reported promptly.
12.7 You must not attend while under the influence of alcohol, illegal drugs or any substance that makes participation unsafe.
12.8 Smoking and vaping are not permitted inside the premises.
12.9 Commercial activity, unauthorised personal training, selling and solicitation are not permitted without our prior written approval.
12.10 We may introduce or update reasonable operational and safety rules. Important changes will be communicated to members.
13.Personal belongings
13.1 Please bring only essential items and use designated storage where available. Do not bring valuable items unless necessary.
13.2 We are responsible for loss of or damage to personal property only where it results from our negligence or another matter for which liability cannot lawfully be excluded. Nothing in this section removes any statutory right or legal remedy.
13.3 Property left behind may be held for a reasonable period and then donated, recycled or disposed of. We may dispose of perishable, unhygienic or hazardous items immediately.
14.Facilities, timetable and closures
14.1 Membership does not guarantee that a particular class, coach, item of equipment or area will always be available.
14.2 We may make reasonable changes to the timetable, coaching team, equipment, layout, operating hours or services to maintain and improve the gym or respond to demand, safety, staffing or operational needs.
14.3 We may temporarily close all or part of the premises for maintenance, refurbishment, emergencies, safety reasons, events or circumstances outside our reasonable control.
14.4 Where a closure is substantial or prolonged, we will consider an appropriate membership extension, freeze, credit or refund, taking account of the length and effect of the closure and your statutory rights.
15.Suspending or ending access
15.1 We may immediately suspend access where reasonably necessary to protect safety, investigate serious misconduct, prevent unauthorised access or address unpaid fees.
15.2 We may end membership for a serious or repeated breach of these terms, including violence, threats, harassment, deliberate damage, dangerous equipment use, membership sharing or persistent non-payment.
15.3 Except where immediate action is reasonably necessary, we will explain the concern and give you a reasonable opportunity to respond or correct it.
15.4 If we end the agreement without fault on your part, we will refund any prepaid amount relating to the unused period. If we end it because of your serious breach, any amount retained will be fair and proportionate to the loss caused and services already supplied.
16.Liability
16.1 We do not exclude or limit liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, breach of your statutory rights, or any other liability that cannot legally be excluded or limited.
16.2 Subject to section 16.1, we are not responsible for a loss that was not reasonably foreseeable when the agreement was made, or for a loss caused by your failure to follow reasonable instructions, disclose relevant information or exercise reasonable care.
16.3 Nothing in these terms requires you to accept the risk of negligent instruction, unsafe equipment or another failure by Just Train to exercise reasonable care and skill.
17.Personal information and privacy
17.1 We process personal information for membership administration, payments, bookings, safety, communications and other purposes explained in our privacy notice: [INSERT PRIVACY NOTICE LINK OR LOCATION].
17.2 Health information is treated as sensitive personal information and will be accessible only where reasonably necessary for safety, coaching, administration or legal obligations.
17.3 Promotional email or text marketing is optional and is not a condition of membership. You may withdraw marketing permission at any time.
17.4 Acceptance of these terms does not give Just Train permission to use identifiable photographs or videos of you for advertising or promotional purposes. Any such permission must be requested separately and may be declined or withdrawn without affecting membership.
17.5 Photography or filming by members must not unreasonably capture other people or interfere with their privacy. Staff instructions about filming must be followed.
18.Changes to fees and these terms
18.1 We may change fees for a monthly rolling membership by giving at least one month's clear advance notice. If you do not accept the new fee, you may cancel before it takes effect without an additional cancellation charge.
18.2 A price already paid for a fixed-term membership, package, course or individual booking will not be increased retrospectively.
18.3 We may update these terms for legal, regulatory, safety, security or reasonable operational reasons. We will give reasonable advance notice of any material change that adversely affects members.
18.4 A material change will not remove an accrued right. Where a change significantly alters the service you purchased to your detriment, you may have the right to cancel, and we will explain any available option when notifying you.
19.Complaints and contact
19.1 If you have a concern or complaint, please speak to a member of the Just Train team or contact us through the gym software, at the customer contact email above, or at our postal address.
19.2 We will acknowledge and investigate complaints fairly and aim to provide a clear response within a reasonable time.
20.General provisions
20.1 If any part of these terms is found to be unlawful or unenforceable, the remaining terms will continue to apply.
20.2 A delay in enforcing a term does not waive the right to enforce it later.
20.3 These terms, together with the product information shown at purchase and any policies expressly incorporated into them, form the agreement between you and Just Train.
20.4 No person other than you, Just Train and—where applicable—the parent or legal guardian of a 16- or 17-year-old member has a right to enforce this agreement.
20.5 These terms are governed by the law of England and Wales. You may bring proceedings in the courts with jurisdiction under applicable consumer law.
